  It would have been quite understandable it he was accused because of the post itself (its title and content) as at least he created the post based on his own thoughts and published it himself. But paying a huge fine for what other people said in the comments? That's really beyond my understanding!

  If I understand correctly, the lawsuit was made because of a "Google-Bombing" scheme that was promoted by this blog against SGAE... (It succesfully changed the results in a google search page, so that when you typed "sgae" in google, the first result would be the SGAE=Thieves page)... Does anyone know if there's any precedent to this kind of "defamation" lawsuit against a blog anywhere in the world?.... The lawsuit itself has little to do with music, I think... It's more about "defaming" the spanish RIAA...

  This sounds like a defamation case to me. Publishing content that is "per se" defamatory (such as so and so is a thief or so and so has AIDS) is an easy court win.

  In Germany similar laws apply to both bloggers and people running forums. They are held responsible for user comments which means they have to actively monitor and remove comments if they could be labeled libel,... So some bloggers have only allow pre-approved comments because they could be in serious trouble if a comment is for several hours on their blogs.

  I'm Spanish, so I've known about this for some time now as I quite like that blog. The SGAE is the worst thing ever, they damage their own industry because what they claim is for no one else but them, I consider it Terrorism against the Internet and against people who just try to give their opinion in a matter that affects everybody...
